হাবিব সাহেব ইতালি প্রবাসী। দীর্ঘ সময়ের জমানো টাকায় ঢাকার সাভারে ৪ কাঠা জমি কিনেছেন ২০০৮ সালে । পারিবারিক জরূরী প্রয়োজনে নগদ টাকা দরকার। এত টাকা জোগাড় করতে জমি বিক্রী করা ছাড়া আর কোন উপায় নেই তার। যেহেতু হাবিব সাহেব বর্তমানে ইতালি আছেন তাই দেশে এসে জমি বিক্রী করা সম্ভব নয়। এ রকম পরিস্থীতিতে হাবিব সাহেব কিভাবে বিদেশে থেকেই বাংলাদেশে জমি বিক্রী করবেন সে বিষয়ে পরামর্শ নিতে আইন বিশারদের অফিসে উপস্থিত তার বড় ছেলে ইয়ামিন।
বাংলাদেশ সরকারের রাজস্ব আদায়ের খাত সমূহের মধ্যে ভূমি উন্নয়ন কর একটি এবং এই খাত থেকে প্রতিবছর বিপুল পরিমাণ রাজস্ব সরকার আহরণ করে থাকে। যেহেতু ভূমির মালিকানা ব্যাক্তি নামে হলেও এর প্রকৃত মালিক মূলত বাংলাদেশ সরকার কাজেই সে জমি ব্যবহারের জন্য বাংলাদেশ সরকারকে খাজনা প্রদান করতে হয়।
কেউ যদি জিবিত অবস্থায় তাহার সম্পত্তি সম্পূর্ণভাবে কারো নামে লিখে দিতে চায় তাহলে দানপত্র দলিল এর মাধ্যমে সহজেই হেবা করে দিতে পারবে। আমাদের দেশে যা হেবা দলিল নামে অধিক পরিচিত। দান শব্দের আরবী প্রতিশব্দ হেবা। কোন অর্থ বা বিনিময় ছাড়া কোন ব্যক্তি স্বেচ্ছায় যে দলিলের মাধ্যমে কোন সম্পত্তি হস্তান্তর করেন তাকে দানপত্র বলে।
চেকের মামলায় মহামাণ্য হাইকোর্ট ডিভিশান অতি সম্প্রতি একটি যুগান্তকারী রায় প্রদান করেছেন। রায়ে চেকে লেনদেন সংক্রান্ত কোন লিখিত ডকুমেন্ট বা দুই পক্ষের কনসিডারেশন কে গুরুত্ব দেয়া হয়েছে। কাজেই, চেকের লেনদেনের ক্ষেত্রে সম্ভব হলে স্ট্যাম্পে লিখিত চুক্তি করে নেয়া ভাল। তবে, চেকের মামলা করতে চুক্তি থাকতেই হবে এ ধারনা ভূল।
তালাক দিলেই সাথে সাথে সেই তালাক কারযকর হয় না। মুসলিম শরীয়া আইন এবং পারিবারিক আইনের বিধান মতে তালাক দিবার ৯০ দিন পর সেই তালাক কার্যকর হবে। ৯০ দিনের এই সময়কে ইদ্দতকালীন পিরিয়ড বলা হয়। তালাক দেবার পর তালাক দাতা যদি মনে করে তার সিদ্ধান্ত ভূল এবং সে এই তালাক বাতিল করতে চায় তাহলে তালাক গ্রহীতার নিকট লিখিত নোটিশ দিয়া তালাক প্রত্যাহারের বিষয়টি জানাতে হবে।
জমি বেচা-কেনা বা হস্তান্তর করা, জমির অনুকূলে ব্যাংক হইতে বন্ধক রেখে লোন উঠাতে গেলে বা সরকারী বন্দোবস্তের টাকা উঠাতে এমন কি জমিতে বিল্ডিং করার জন্য প্লান পাশ করাতে গেলেও এসব কাগজপত্র প্রয়োজন হয়।
